3 Reasons People Who Slip and Fall At Walmart May Need to Retain A Lawyer.

San Antonio Injury Lawyer Explains Slip and Fall AccidentsIf you slipped and fell at a Walmart store in the recent past, chances are that the following apply to your slip and fall accident:

  1. Walmart isn’t taking your claim seriously,
  2. They promised to have someone call you back, but you haven’t heard from anyone, or
  3. They denied your claim outright.

As a San Antonio injury lawyer, I have noticed that there appears to be an increase in slip and fall accidents at Walmart stores over the last couple of years.  This is likely due three factors:

  1. The rapid growth of Walmart,
  2. A quickly growing customer base, and
  3. Cost cutting measures taken by Walmart.

Over the last ten years Walmart has been one of the fastest growing grocery store chains in the United States, bringing in new customers and building new stores with alarming frequency.  As such, Walmart is now one of the largest grocery retailers in the United States.

However, there are likely several factors that has lead to what I perceive to be an increase in slip and fall accident claims, at least here in San Antonio.

First, Walmart is growing rapidly, and as any business owner knows, growing too rapidly can lead to a breakdown in systems and oversight, which, I believe may be leading to a lack of training regarding the handling of slip and fall injury claims.  This may be why valid slip and fall claims are being ignored.

Second, Walmart’s growing customer base means that there are more and more customers in Walmart stores at any given time, which increases the frequency of spills, or other factors that lead to slip and fall accidents.

Lastly, anyone who has frequented a Walmart in recent years, at least as far as I’ve observed, knows that there never seems to be enough staff on hand, whether it be sales associates, cashiers, or cleaning crew.  This is likely due to the fact that Walmart is a business, and thus their primary goal is to make money.  Running with a skeleton crew helps them save thousands of dollars in wages.  However, this reduction in staff is also a recipe for disaster when it comes to factors leading to personal injuries from slip and fall accidents.  Spills, and other obstacles that lead to accidents will obviously not be attended to as quickly when there aren’t sufficient staff members available.  The longer these spills and obstacles remain in the aisle of traffic, the more likely it is that someone will become injured as a result of the obstacle.

Additionally, Walmart’s response to seemingly valid claims has been to either ignore the person completely, or to simply deny the claim.  This is why those who have slipped and fallen in a Walmart (or HEB or other large chain store) would be wise to consult with an experienced injury lawyer regarding their case.

Do I Have a Case?

In Texas, customers are classified as “invitees” and as such, Walmart owes its customers the following duty of care:

  • A duty to inspect their premises to ensure it is reasonably safe.
  • A duty to give a proper warning of any known defects, and take proper measure to eliminate such defects.
  • However, they may not be liable for “unknown” defects.  Whether a defect is “known” or “unknown” depends upon underlying details and circumstances surrounding the defect.

Slip and fall injuries are difficult cases in Texas, and as such, you need to act quickly in order to preserve the value of your claim.  This is why I recommend consulting with a Texas injury lawyer if you’ve been involved in a slip or trip and fall case in Texas.
